RATSTUDIOS SPEAKERS RULES OF 03.11.2016

I. Definitions

The terms used in the Regulations mean:

1. Customer – a person, legal person or organizational unit (not a legal person), with legal capacity to place an Order within the Store;

Civil Code – Act of 23 April 1964 (Journal of Laws No. 16, item 93);

3. Terms and Conditions – Terms and Conditions of Electronic Services within the RATstudios Speakers Online Store;

4. Online Shop (Online Shop) – Internet service available at www.ratstudios.pl/speakers/, through which the Customer may in particular submit Orders;

5. Goods – products presented in the Internet Shop;

6. Sales Agreement – Contract of Sale of Goods within the meaning of the Civil Code, concluded between RATstudios Katarzyna Pisarczyk and the Customer, concluded with the use of the Shop’s Internet site;

7. Consumer Rights Act – Law of 30 May 2014 on Consumer Rights (Journal of Laws of 2014, item 827);

8. Electronic Services Act – Act of 18 July 2002 on providing services by electronic means (Journal of Laws No. 144, item 1204, as amended);

9. Order – statement of the will of the Customer, aimed directly at the conclusion of the Sales Agreement, specifying in particular the type and number of the Goods.

II. General provisions

2.1. These Regulations defines the rules for the use of the online store available at www.ratstudios.pl/speakers/.

2.2. These Regulations are the regulations referred to in art. 8 of the Act on providing services by electronic means.

2.3. The Internet shop, run by www.ratstudios.pl/speakers/, is run by RATstudios Katarzyna Pisarczyk, based at ul. Bankowa 14/16/14, 87-100 Torun, Poland, NIP 517-019-83-34.

2.4. These Regulations specify in particular:

a) rules of registration in the customer’s online store;

b) the terms and conditions of electronic booking of products available through the online store;

c) terms and conditions of electronic submission of Orders within the online store;

d) rules for concluding Sales Agreements using the services provided within the Online Shop.

2.6. In order to use the online store, the customer should have access to a computer station or terminal, with access to the Internet.

2.7. In accordance with applicable law RATstudios Katarzyna Pisarczyk reserves the right to limit the provision of services via the Online Store to persons over the age of 18 years. In this case, potential customers will be notified about this.

2.8. Customers can access these Terms and Conditions at any time via the link on the main website www.ratstudios.com/speakers/ and download and print it.

2.9. Information on the Goods, which is provided on the website of the Shop, in particular their descriptions, technical and service parameters and prices, constitute an invitation to enter into a contract within the meaning of art. 71 Civil Code.

III. Terms of Use of the Online Shop

3.1. To start using the Internet Store, fill out the order form.

3.2. Registration is made by completing and accepting the form  available on one of the Shop pages.

3.3. The condition of registration is the consent of the content of the Regulations and filling the personal data marked as mandatory.

3.4. RATstudios Katarzyna Pisarczyk may deprive the Client of the right to use the Internet Store, as well as may limit its access to some or all of the resources of the Internet Store, with immediate effect, in the event of violation by the Customer of the Terms, and in particular when the Customer:

a) has provided, during the online registration,  inaccurate or outdated information, misleading or infringing the rights of third parties,

b) committed through the online store infringing personal property of third parties, in particular the personal interests of other customers of the online store,

c) Other behaviors that will be considered by RATstudios for behavior that is inconsistent with applicable laws or general Internet usage rules, or which is disruptive to good name of RATstudios.

3.5. A person who has been denied the right to use the online store can not re-register without the prior consent of RATstudios.

3.6. In order to ensure the safety of the transmission of messages and data in connection with the services provided within the Site, the Online Shop shall take technical and organizational measures appropriate to the degree of security of the services provided, in particular measures to prevent the unauthorized access and modification of personal data transmitted on the Internet.

3.7. The Client is obliged in particular to:

a) not to provide and not to transmit content prohibited by law, such as content promoting violence, defamation or infringement of personal and other rights of third parties,

b) use the Online Store in a way that does interfere with its operational running, in particular by using specific software or devices,

c) not to take action such as: distributing or posting unsolicited commercial information (spam) within the Online Store;

d) to use the Online Store in a manner that is unobtrusive to other customers and to RATstudios,

e) use of any content contained within the Online Shop solely for personal use,

f) use of the Internet Store in accordance with the law of the Republic of Poland, the provisions of the Regulations, as well as the general rules of using the Internet.

IV. Procedure for conclusion of the Sale Agreement

4.1. In order to complete the Sale Agreement via the Online Shop, go to www.ratstudios.com/speakers/, select the model of the column, and if there is a veneer option, take further technical steps based on the displayed messages and the information available on the website. .

4.2. The ordering of the ordered goods by the Customer is made by completing the order form.

4.3. When ordering – until the “Order” button is pressed – the customer has the possibility to modify the entered data and to select the Goods. To do this, you must follow the displayed messages and the information available on the website.

4.4. When the Customer uses the Online Store all the necessary data and clicks “Order”, the e-mail will be sent with summary of the order placed. The summary of your Order will include information on:

a) the subject of the order,

b) unit and total price of ordered products or services, including delivery costs and additional costs (if any);

c) the selected payment method,

d) the method of delivery chosen,

e) time of delivery,

4.5. In order to send the Order, it is necessary to accept the content of the Regulations, and filling in the personal data marked as mandatory and clicking the button “Order”.

4.6. Sending the Order is a statement of intent to conclude Sales Agreements with RATstudios, in accordance with the Terms and Conditions. 1

4.7. After placing the Order, the Customer receives an email entitled “Order Confirmation”, containing the final confirmation of all relevant elements of the Order and the pro-forma invoice.

4.8. The contract is treated as concluded with the receipt of the e-mail mentioned above.

4.9. The sales contract is in Polish, with the content in accordance with the Regulations.

V. Delivery

5.1. Delivery of Goods is limited to the territory of the Republic of Poland and European Union and takes place at the address indicated by the Customer during the Order submission.

5.2. Delivery of ordered goods takes place by courier or personal receipt. Delivery costs are Euro 30. In addition, delivery costs will be indicated at the time of placing the Order.

5.3. Delivery time is from 10 to 20 working days from the date of dispatch of the Order.

5.4. Customers can access these Terms and Conditions at any time via the link located on the main website of ratstudios.pl/speakers/ and download and print it.
Confirming, securing, making available to the Customer significant provisions of the Contract for the Sale of Goods shall be made by sending to the Customer the given e-mail address and by attaching the Confirmation Order, the Order Specification and the VAT invoice.

VI. Prices and methods of payment

6.1. Commodity prices are quoted in Polish zloty or Euro and include all taxes, including VAT, and all other ingredients.

6.2. The customer has the possibility to pay the price:

a) by bank transfer to the bank account number on the VAT invoice,

VII. Right of withdrawal.

You are entitled to withdraw from this contract within 14 days without giving any reason.

The expiration date will expire 14 days after the date on which you came into possession of the item or a third party other than the carrier and indicated by you came into possesion of the goods.

To execute your right of withdrawal, you must inform us by e-mail to kontakt@ratstudios.pl about your decision to withdraw from this contract by expressing your withdrawal. You have the right to withdraw from the contract before the expiry date of the withdrawal stated in contract.

Consequences of withdrawal

In the event of withdrawal from this contract prior to shipping, we will refund all payments received from you, including the cost of delivery of the item (except for additional costs resulting from your choice of delivery other than the cheapest delivery method offered by us) immediately and in each case. no later than 14 days from the date we were informed of your decision to execute the right of withdrawal from this contract. We will refund you using the same payment methods you used in your original transaction, unless you have explicitly agreed otherwise. In any case you will not be charged in connection with this refund.
We may withhold payment until the item is received or until we receive a proof of return, depending on which event occurred earlier.
Please return or transfer the goods to us immediately, and in any event not later than 14 days from the date on which we informed you of the termination of contract. The deadline is met if you send the item before the 14-day deadline.

You only answer for the reduction of the value of the things resulting from the use of it in a way other than necessary to establish the characteristics and functioning of the Goods.

VIII. Complaints regarding Goods

8.1. RATstudios Katarzyna Pisarczyk as a seller is responsible in front of consumer being a consumer within the meaning of art. 22 [1] of the Civil Code, in respect of defects described in the Civil Code, in particular Art. 556 and Art. 556 [1] – 556 [3] of the Civil Code.

8.2. Complaints arising from violations of rights guaranteed by the Client, or pursuant to these Regulations, should be addressed to kontakt@ratstudios.pl. RATstudios undertakes to process any complaint within 14 days, and if it is not possible, to inform Customer during this period when the complaint will be processed.

8.3. RATstudios is a manufacturer of goods. The manufacturer is liable for the guarantee of the goods sold under the terms and for the period indicated in the warranty card. If the guarantee document provides such an opportunity, the customer may claim his / her warranty under the guarantee directly at an authorized service center whose address is included in the warranty card.

IX. Complaints regarding the provision of services by electronic means

9.1. RATstudios takes steps to ensure that the Store is fully operational, to the extent that it is based on current technical knowledge, and undertakes to remove, within a reasonable time, any irregularities reported by Customer.

9.2. The customer is obliged to immediately notify RATstudios of any irregularities or interruptions in the functioning of the Internet Store.

9.3. Abnormalities related to the functioning of the Shop Customer may report in writing to: ul. Bankowa 14/16/14, 87-100 Toruń, Poland, mail to contact@ratstudios.pl or using the contact form.

9.4. In the complaint, the Customer should provide his / her name, mailing address, type and date of occurrence of anomalies related to the functioning of the Store.

9.5. RATstudios undertakes to process any complaint within 14 days, and if it is not possible, to inform Customer during this period when the complaint will be processed.

X. Final regulations

10.1. Settlement of possible disputes arising between RATstudios and the Customer, who is a consumer within the meaning of Art. 22 [1] of the Civil Code, shall be submitted to the competent courts in accordance with the provisions of the relevant provisions of the Code of Civil Procedure.

10.2. Settlement of possible disputes arising between RATstudios and a Customer who is not a consumer within the meaning of art. 22 [1] of the Civil Code of the Civil Code, is submitted to the court of competent jurisdiction for the seat of RATstudios.

10.3. In matters not regulated in these Regulations, the provisions of the Civil Code, the provisions of the Act on providing services by electronic means and other relevant provisions of Polish law apply.
